Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Baul mobile application (“the App”) operated by FFWD Florian Werner Digital Ventures (“us”, “we”, or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to any part of the Terms, then you may not access the App.

1. Eligibility

The App is intended for users of all ages, following the App Store Connect guideline of 4+. However, if you are under the age of 13, you must obtain permission from a parent or legal guardian before using the App.

2. Subscriptions and Free Trial

2.1. Free Trial

Availability: The App offers a free trial period to new users.
Access: During the free trial period, you will have full access to all subscription features.
Duration: The duration of the free trial period will be specified at the time of sign-up.
Automatic Conversion: Unless you cancel at least 24 hours before the end of the free trial period, you will be automatically enrolled in the subscription plan you selected when initiating the trial, and your Apple ID account will be charged accordingly.

2.2. Subscription Requirements

Subscription Plans: Subscriptions are available on a monthly or yearly basis.
Payment: Payment will be charged to your Apple ID account upon confirmation of purchase or at the end of the free trial period if not canceled.
Pricing: All prices are subject to change at our discretion, but you will be notified of any price changes before they take effect.

2.3. Auto-Renewal

Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period or free trial period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.
Managing Subscriptions: You can manage and cancel your subscriptions or free trial by going to your account settings on the App Store after purchase.

2.4. Cancellation

During Free Trial: To avoid being charged, you must cancel the free trial at least 24 hours before it ends.
Subscription Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.
No Refunds: We do not offer refunds for unused portions of a subscription period or free trial.

2.5. Forfeiture of Free Trial

Unused Portion: Any unused portion of a free trial period will be forfeited when you purchase a subscription before the trial ends.

3. Use of the App

3.1. Personal Use

The App is intended for your personal, non-commercial use.
You agree not to misuse the App or help anyone else to do so.

3.2. Health Disclaimer

Not Medical Advice: The App is not a substitute for professional medical advice, diagnosis, or treatment.
Consult Professionals: Always consult a qualified healthcare provider with any questions you may have regarding a medical condition.
No Delay in Seeking Help: Never disregard professional medical advice or delay seeking it because of information provided by the App.

4. User Content

Local Storage: All data you enter into the App remains locally stored on your device.
No Access: We do not have access to, nor do we collect or store, your personal health data.
Your Responsibility: You are responsible for maintaining the confidentiality and security of your device and data.

5. Privacy Policy

Governance: Your use of the App is also governed by our Privacy Policy.
Consent: By using the App, you consent to the collection and use of information as outlined in the Privacy Policy.

6. Intellectual Property Rights

Ownership: All content, features, and functionality of the App are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
License: You are granted a limited, non-exclusive, non-transferable license to use the App for personal use.

7. Third-Party Services

Superwall: The App uses Superwall for subscription handling.
Third-Party Terms: By using the subscription services, you agree to Superwall’s terms and policies.
No Liability: We are not responsible for the practices of Superwall or any other third-party services.

8. Disclaimers and Limitation of Liability

8.1. Disclaimers

AS IS Basis: The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
No Warranty: We do not warrant that the App will function uninterrupted or error-free.

8.2. Limitation of Liability

No Indirect Liability: To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
Liability Cap: Our total liability to you for any damages shall not exceed the amount you have paid us in the last 12 months.

9. Governing Law and Jurisdiction

Applicable Law: These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Erlangen, Germany.

10. Changes to Terms

Right to Modify: We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
Notice of Changes: If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
Acceptance of Changes: By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.
